A Florida state court judge has ordered a developer to restore a Miami waterfront condominium to a habitable state after it was gutted during a yearslong legal battle. In a Jan. 12 order, Miami-Dade Judge Thomas Rebull sided with eight residents who sued to block the sale of the Biscayne 21 condo building, directing the defendants—Two Roads Development and its affiliated entities—to restore the apartment tower and the plaintiffs' units "to the condition they were in at the time the complaint was filed in May 2023," according to a court filing obtained by Realtor.com®.

Question: I live in a small phase of my community. The second quarter of this year our assessment fees were raised 110% overnight. We didn't receive any prior written notice of the increase. We just got the quarterly bill with the increase shown. Our bylaws and Section 720.303 of Florida law state that assessment increases cannot be more than 5%. When I approached the board, they just gave a backhanded answer for the increase. Is there anything we can do to have them show the real reason for the increase? I've already discovered that they've broken many rules of the covenants and bylaws. If they voted improperly for this increase without members voting isn't that illegal as well? Signed, M.C.

The health department rule is that only commercially bottled water is allowed in the wet deck area (4’ around the perimeter of the pool), but our community has a rule that bans food or beverages (other than water) through the entire fenced pool area.
