A “There is nothing in the law,” says Robert L. Kaye, Esq., the managing member of Kaye Bender Rembaum, a full
service commercial law firm based in Fort Lauderdale, “of that precludes a lawyer representing a condominium association from
purchasing a foreclosed unit and re-selling it for a profit. Presumably, the information the attorney used in the process was all available
in the Public Records. To avoid potential ethical concerns, it is recommended that the attorney notify
the board of the intent in advance of doing so.”
